fa بستری و درمان اجباری: نگاهی به قوانین بهداشت روان Involuntary Treatment and Hospitalization: Review of Mental Health Acts روانپزشکی و روانشناسی Psychiatry and Psychology مروري Rewie هدف: نادیده‌گرفتن حقوق و آزادی بیماران روانی در جهان شایع است. در حالی که تا سال‌های میانی سده بیستم بیشتر قوانین برای حمایت از جامعه در برابر بیماران روانی وضع شده بود، در سال‌های اخیر دیدگاه قانون‎گذاران برحفظ حقوق بیماران روانی متمرکز شده است. این بررسی با هدف بازبینی قوانین بستری اجباری کشورها و توصیه‌های سازمان جهانی بهداشت در این زمینه انجام شده است. روش: در یک بررسی مروری، قوانین بهداشت روان برخی کشورها به‌ویژه در زمینه بستری اجباری بازبینی شده است. اطلاعات این پژوهش در طول مدت دو سال با بازبینی بیش از چهل پایگاه اطلاع‌رسانی و جستجوی دستی پانزده منبع در دسترس، گردآوری شده، قوانین بستری اجباری کشورها و هم‌چنین توصیه‌های سازمان جهانی بهداشت در حوزه‌های تفکیک بستری و درمان اجباری، ایجاد محیط‌هایی با کمترین محدودیت، ملاک‌های بستری اجباری، مراجع تشخیص و تأیید بستری اجباری و نیز طول مدت بستری اجباری مقایسه گردیده است.یافته‌ها: این بررسی نشان داد که سازمان جهانی بهداشت و هم‌چنین بیشتر کشورهای مورد بررسی بر لزوم رعایت اصول زیر در تدوین قوانین بستری اجباری تأکید کرده‌اند: ایجاد محیط با کمترین محدودیت، وجود ملاک‌های ”خطرناک‌بودن“ و ”نیاز به درمان“ برای بستری اجباری فرد، لزوم تشخیص اندیکاسیون بستری اجباری توسط دو نفر، لزوم تأیید اندیکاسیون یادشده توسط مرجع بی‌طرف و طول مدت محدود بستری اضطراری در حد چند روز. هم‌چنین فرآیند بستری و درمان اجباری در برخی کشورها تفکیک و در برخی دیگر ادغام شده است.نتیجه‌گیری: با توجه به اهمیت رعایت حقوق متقابل بیمار روانی و جامعه، بستری اجباری دربرگیرنده بخش بزرگی از قانون بهداشت روان است. سازمان جهانی بهداشت که بستری اجباری را نه‌تنها محرومیت از آزادی بلکه یک ضربه روانشناختی می‌داند، اصولی را برای تدوین قانون بستری اجباری، ضروری دانسته است. از سوی دیگر با توجه به کاستی‌های قوانین مربوط به این موضوع در ایران، لزوم از میان برداشتن کاستی‌ها و قانونمندشدن روند بستری اجباری احساس می‌شود. <p class="MsoNormal" style="TEXT-JUSTIFY: kashida MARGIN: 0cm 6.5pt 0pt 0cm DIRECTION: ltr TEXT-INDENT: 0cm LINE-HEIGHT: 11pt unicode-bidi: embed TEXT-ALIGN: justify TEXT-KASHIDA: 0% mso-line-height-rule: exactly">Abstract<p class="MsoNormal" style="TEXT-JUSTIFY: kashida MARGIN: 0cm 6.5pt 0pt 0cm DIRECTION: ltr TEXT-INDENT: 0cm LINE-HEIGHT: 11pt unicode-bidi: embed TEXT-ALIGN: justify TEXT-KASHIDA: 0% mso-line-height-rule: exactly">Objectives: Disregard of the rights of the mentally ill is a prevalent condition in the world. Whereas until the mid twentieth century most legislations were enacted to protect the society against individuals with mental disorders, in recent years the attitudes of legislators has been focused on protecting the rights of the mentally ill. The aim of this study is to review the laws related to involuntary hospitalization in different countries, and world Health Organization (WHO)’s recommendations in this regard. <p class="MsoNormal" style="TEXT-JUSTIFY: kashida MARGIN: 0cm 6.5pt 0pt 0cm DIRECTION: ltr TEXT-INDENT: 0cm LINE-HEIGHT: 11pt unicode-bidi: embed TEXT-ALIGN: justify TEXT-KASHIDA: 0% mso-line-height-rule: exactly">Method: In a review study, the mental health act of some countries especially concerning involuntary hospitalization is evaluated. Information was gathered in a two year period through review of more than 40 electronic sources and hand searching 15 available sources. Laws of involuntary hospitalization of countries as well as World Health Organiza- tion comments on separation of involuntary treatment and hospitalization, establishing environments with the least restrictions, criteria for involuntary hospitalization, authorities of diagnosis and certification of involuntary hospitalization and the duration of involuntary hospitalization were compared. <p class="MsoNormal" style="TEXT-JUSTIFY: kashida MARGIN: 0cm 6.5pt 0pt 0cm DIRECTION: ltr TEXT-INDENT: 0cm LINE-HEIGHT: 11pt unicode-bidi: embed TEXT-ALIGN: justify TEXT-KASHIDA: 0% mso-line-height-rule: exactly">Results: This study reveals that the WHO and most studied countries have emphasized the imposing of the following rules: The establishment of the least restrictive environment, the presence of “dangerousness” and “need to treatment” as criteria for involuntary hospitalization, the requirement of two accredited persons for determination of indication of hospitalization, the approval of the mentioned indication by an impartial source, and the limitation of the duration of emergency hospitalization to a few days. WHO considers involuntary hospitalization to be not only a deprivation of liberty but also a psychological trauma, and deems the establishing of principles for involuntary hospitalization law necessary.
